Criminal Conduct:  Overview

● Service provider as victim of computer crime.

● Service provider liability due to breach of duty to secure system from viruses and hackers.

● Service provider liability on theory of vicarious liability.

● If user’s underlying conduct is actionable and service provider knew or should have known of the illegal nature of the conduct, it may be liable.
